("KANS CAPITAL"), with address at Paseo de los Tamarindos 384 – 1102, Colonia Bosques de las Lomas, Alcaldía Cuajimalpa, Postal Code 05119, Mexico City, Mexico, informs you that KANS CAPITAL is responsible for the processing of the personal data it requests and that all your information is handled strictly under physical, technical, and administrative security measures.

Data marked with an * is considered sensitive; therefore, when requesting a service, we will make this privacy notice available to you and request that it be signed, which will represent express consent regarding the processing of your personal data.

II. Primary or necessary purposes:

  • Manage the Recruitment and Selection process for candidates applying to become KANS CAPITAL Employees.

EMPLOYEES

  • Carry out the Employee hiring process.
  • Manage KANS CAPITAL Employees (training, payroll distribution, file updates, etc.).

III. Secondary purposes, not necessary, or that do not give rise to the legal relationship with KANS CAPITAL:

CLIENTS

  • No secondary purposes apply.

CANDIDATES

  • Retain your information for at least 1 year for future job applications:

IV. Transfer of personal data

The only data transfers that may be carried out will be to cover the following circumstances:

  1. A legal provision requires it,
  2. a request is made by a competent authority,
  3. the transfer is necessary or legally required to safeguard a public interest or for the prosecution or administration of justice, or
  4. the transfer is required for the recognition, exercise, or defense of a right in a judicial proceeding, and
  5. the transfer is required for the maintenance or performance of a legal relationship between KANS CAPITAL (Data Controller) and you (Data Subject).
  6. express authorization is obtained from you (Data Subject) to share your information or information for which you are responsible.

In accordance with the foregoing, we inform you that transfers may be made to:

  • Authorities that require the information under applicable law.
  • Entities within our own corporate group, which operate under KANS CAPITAL’s same internal processes and policies.
  • Authorities that request it as part of a judicial or administrative proceeding where it is necessary to disclose information or personal data.

In any case, whether the transfer is domestic or international, we will deliver or make available to the recipient this Privacy Notice, and ensure the recipient assumes, at minimum, the same obligations to which KANS CAPITAL is subject. This will be done through contractual clauses or other legal instruments entered into between KANS CAPITAL and the data recipients, or electronic/automated acceptances of such terms.

We inform you that the transfers listed in this section are all permitted under Article 37 of the Law, and therefore this Privacy Notice is not required to include a clause for acceptance of personal data transfers.

We also note that KANS CAPITAL may need to share (remit) information or personal data with service providers (processors), and should these providers require data processing, they will use the information or personal data solely on our behalf, in accordance with our instructions and under the terms of the written contract establishing the scope and content of our relationship with the corresponding provider (processor).

V. Handling of Access, Rectification, Cancellation, and Objection rights (ARCO Request), Revocation of consent, and Limitation of processing.

The Federal Law on Protection of Personal Data Held by Private Parties grants rights that you, as the Data Subject or owner of the personal data, may exercise with respect to your personal data at any time. These rights are known as “ARCO Rights” and are as follows:

  1. Access the personal data held by KANS CAPITAL, as well as learn the details of its processing,
  2. Rectify such data if it is outdated, inaccurate, or incomplete,
  3. Cancel it, and
  4. Object to its processing for specific purposes.

A. Procedure forsubmittingan ARCO Rights request

This procedure may be used to exercise ARCO Rights, revoke consent, or request limitation of processing carried out by KANS CAPITAL for any Data Subject or data owner, as well as for any other request relating to the processing of personal data or information that KANS CAPITAL may process.

As the Data Subject, you must send an email to DataPrivacy@kanscapital.com, accompanied by the following information and documentation:

  1. Full name of the Data Subject.
  2. Email address of the Data Subject to which the response to the request will be sent.
  3. If applicable, the corporate name of the Client you represent.
  4. If applicable, the type of relationship you have with the Client and institutional email address.

Attach the following documentation:

  1. Valid official identification proving the identity of the Data Subject and/or requester.

If legal representation is required, the following must also be attached:

  1. Valid official identification of the Data Subject and the Legal Representative.
  2. A public instrument (power of attorney before a notary public) or a letter of attorney signed before 2 witnesses, or a personal appearance declaration by the data subject, in order to prove the representative’s authority

Regarding the ARCO right to be exercised, revocation of consent, or limitation of processing carried out by Kans Capital, please indicate:

  1. A clear and precise description of the personal data or information for which you seek to exercise any of the aforementioned rights.
  2. Any other element or document that facilitates locating the personal data or information processed.

Regarding any other information request you wish to make, please indicate:

  1. A clear and precise description of your request.
  2. Justification or reason why you require the request to be addressed.

Once the request to exercise ARCO Rights is available to KANS CAPITAL, the Data Controller within KANS CAPITAL will issue a response within a period not to exceed 20 (twenty) business days from the date of receipt.

If additional information is required for your request, you will be notified within 5 (five) business days from the date of receipt of the request. You will have 10 (ten) business days to respond to the information request; after this period has elapsed, you must resubmit your request.

Once the response confirming that the request has been addressed is received, KANS CAPITAL will resolve the request within a period of 15 (fifteen) business days.

The aforementioned periods may be extended once, for an equal period, provided the circumstances of the case justify it. If you do not respond to our resolution with any confirmation, we will understand, in good faith, that you agree with the resolution.

We note that, as the party responsible for personal data, KANS CAPITAL may decline to comply with the requested ARCO Right in cases permitted by the Law and its Regulations, in which case we will inform the requester of the reasons for such refusal. The refusal may be partial, in which case we will carry out the access, rectification, cancellation, or objection to the extent applicable.

B. Revocation of consent to the processing of your personal data

You may revoke your consent for the processing of personal data or information by following the same procedure used to exercise your ARCO Rights (see section A of this notice). Once your revocation request is available to Kans Capital, a response will be issued within a maximum period of 5 (five) business days.

C. Options for limiting the use or disclosure of your personal data

You may limit the use or disclosure of your data by following the same procedure used to exercise ARCO Rights (see section A of this notice). Once the request is available to KANS CAPITAL, a response will be issued within a period not to exceed 5 (five) business days.

To further promote the limitation of data use and disclosure, we note that other mechanisms exist, such as the Public Registry to Avoid Advertising (REPEP), administered by the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor) (https://repep.profeco.gob.mx/), and the Public Registry of Users who do not wish to receive advertising information on Financial Products and Services (REUS), administered by CONDUSEF (https://webapps.condusef.gob.mx/reus/app/registro.jsp), in which you may register free of charge.

VI. Questions, complaints, and comments

You may contact us at any time, as we are fully available to address any concerns, complaints, or comments regarding the processing of your information and any personal data we process on your behalf.

VII. Cost of procedures

All of the procedures described above are free of charge; however, by prior agreement between the Data Subject or data owner and/or Client and KANS CAPITAL, a fee may be charged for the means by which the response or information is requested to be sent (if applicable).

VIII. Use of cookies, web beacons, and other similar technologies

We inform you that certain services offered through the Internet may use mechanisms such as Cookies, Web Beacons, and other technologies through which data is collected automatically and simultaneously, such as the originating IP address, browser used, operating system, time of access to the page, making it possible to monitor your behavior as an Internet services user. Below, we define each term:

CookiesCookies: A data file stored on the hard drive of the computer or electronic communications device of a user browsing a specific website, which allows the exchange of status information between that site and the user’s browser. This status information may reveal session identification, authentication, or user preference data, as well as any data stored by the browser regarding the website.

Web beacons: A visible or hidden image embedded within a website or email, used to monitor user behavior on those media. Through these, information such as the originating IP address, browser used, operating system, time of access to the page, and, in the case of email, the association of data can be obtained.

For the foregoing reasons, we inform you that these mechanisms may be disabled at any time, according to the instructions each browser provider has implemented to enable and disable such Cookies and Web Beacons.

Browser controls: Most browsers will allow you to access the cookies stored on your device and delete them individually, or block them for all websites or specific ones. Any preference you have set will be lost if you delete all cookies, including opt-out preferences, since this process requires disabling cookie use.

IX: MODIFICATIONS TO THE PRIVACY NOTICE

This privacy notice may be modified from time to time by KANS CAPITAL. Such modifications will be duly communicated through our website www.kanscapital.com or through any other oral, printed, or electronic means of communication that KANS CAPITAL determines for such purpose, and which will be brought to your attention.
